Draft for review. These terms are not yet in force and cannot be accepted until FUSE publishes them.
The main things you agree to
- You join as an independent member. You are not FUSE's employee, agent or partner, and you cannot make promises for FUSE.
- FUSE is the seller in every sale through your store. You recommend FUSE products, and when you list your own equipment or digital products you sell them to FUSE, which resells them.
- You must be 18 or older, give true details, keep one account and pass identity checks before you are paid.
- Only list what you own and may sell. Describe it honestly. Nothing illegal, unsafe, stolen or counterfeit, and wipe your personal data from devices first.
- Say clearly when you earn from a recommendation, for example with #ad.
- FUSE pays you after the return period, through Stripe. FUSE can hold money back for refunds, chargebacks and guarantee claims and deduct what you owe. Points and FUSE credit are not money and can be removed if they were obtained by abuse.
- You alone are responsible for your own taxes. FUSE reports sellers to the Maltese tax authorities where the law requires it.
- You keep ownership of your content and let FUSE use it to run and promote the programme.
- FUSE can restrict, pause or end your access for the reasons listed in section 17, and tells you why. You can complain free of charge, and you can leave at any time.
- Each side is responsible for the losses it causes, within the limits in section 19. Nothing limits the rights the law gives you that cannot be limited.
- FUSE gives you at least 15 days' notice of changes, and you can leave before they apply. Maltese law applies, without taking away protections your own country's law gives private Igniters.
This summary helps you find the main points. It does not replace the terms: if it and a section below differ, the section applies.

1. About these terms
These terms are an agreement between you and YOT LTD, trading as FUSE (company C93877, VAT MT26786902, 31, Triq l-Imdina, H'Attard ATD9039, Malta, [email protected]). "FUSE", "we" and "us" mean YOT LTD. "You" means the person or business that joins the Igniter programme.
The agreement is made up of:
- these Igniter Programme Terms;
- Schedule A, the Igniter equipment seller terms (version 2026-10-equipment-v2), which apply only when you sell your own used equipment;
- the FUSE Terms of Service, which apply to everyone who uses fuse.systems; and
- the Stripe agreement in section 10, which is between you and Stripe.
If they conflict, Schedule A wins for equipment sales, then these terms, then the Terms of Service. The Privacy Policy explains how FUSE uses personal data; it is information, not part of the agreement.
How the agreement is made: you read these terms, tick the box that says you have read and accept them (it is never ticked for you), and select Create my membership. Until then you can go back and correct anything you typed. The agreement starts when FUSE confirms your membership on screen. FUSE then emails you a confirmation with the version you accepted.
These terms are in English and the agreement is made in English. FUSE keeps a record of the version you accepted, when you accepted it and the exact text, and every version stays published. You can print this page or save it as a PDF at any time, and FUSE sends you a copy on request.
The short summary at the top of this page helps you find the main points. It does not replace these terms: if the summary and a section differ, the section applies.
2. Private and business Igniters
Some rules depend on whether you take part as a private person or as a business. When you set up your store you tell FUSE how you sell:
- Private Igniter: a person who recommends products and now and then sells their own things, outside any trade, business, craft or profession.
- Business Igniter: a self-employed person or a company acting for their trade, business, craft or profession. In Malta this usually means a VAT registration under article 10 or article 11 of the VAT Act.
Answer truthfully and tell FUSE straight away if it changes, for example when you start buying things to resell or register as self-employed. A business must never present itself as a private seller: that is unlawful for traders and it is a breach of these terms.
Where a rule applies to only one group it is labelled "Private Igniters" or "Business Igniters". Everything else applies to everyone. If you are a private Igniter, the consumer protection laws that apply to you stay in force whatever these terms say.
3. Who can join
- You must be 18 or older and confirm your date of birth.
- You must have a FUSE account with a verified email address. One person or business may hold one Igniter membership only.
- The details you give FUSE and Stripe must be true, complete and kept up to date. That includes your name, address, date of birth, tax details and, for a business, its legal name, registration number and VAT status.
- You must not be subject to sanctions, and you must not join if FUSE previously closed your membership for a breach, unless FUSE agrees in writing.
- If you join for a company, you confirm you are allowed to accept these terms for it.
- Keep your sign-in details secret. You are responsible for what is done with your account unless it was used without your permission and you were not careless. Tell FUSE at once if you think someone else has access.
FUSE may refuse an application where it has a valid reason, for example false details, a previous serious breach or a legal restriction. FUSE tells you the reason unless the law does not allow it.
4. How the programme works and FUSE's role
As an Igniter you get a store page at your own address (such as yourname.fuse.systems), can recommend FUSE products, can list your own used equipment and digital products, earn Helpful Points, FUSE credit and, where offered, cash commissions, use the Academy, and can choose a paid plan.
FUSE is the seller in every sale made through your store. The customer buys from FUSE, pays FUSE and gets FUSE's invoice. FUSE handles payment, delivery, returns, refunds and the customer's legal rights, including the 14-day right of withdrawal and the legal guarantee. When you list your own equipment or digital products, you sell them to FUSE and FUSE resells them. Your responsibilities for those items are in section 7 and Schedule A.
You take part as an independent member. Nothing in these terms makes you FUSE's employee, worker, agent, partner or franchisee. You cannot accept orders, make promises or sign anything for FUSE, and you must not say you can. You choose when and how much you take part, and you may promote other businesses too.
FUSE does not promise any level of sales, income or visibility. Results depend on your effort, your audience, the products and the market.
FUSE may improve, change or withdraw features of the programme for a valid reason, such as a change in the law, security, fraud prevention, a supplier or payment provider change, or a product change that affects all Igniters. Where a change makes the programme materially worse for you, FUSE gives you notice under section 23.
5. Your store and your content
"Your content" means everything you add to FUSE: your store name, profile, photos, logo, listings, descriptions, reviews, answers, videos, links and messages.
You keep ownership of your content. You give FUSE a non-exclusive, worldwide, royalty-free licence to host, copy, adapt (for example resize, translate or reformat), display and distribute your content, and to let customers see it, for running, showing and promoting your store, your listings and the Igniter programme, including on FUSE's website, emails, social media and search engines. The licence ends when your content is removed, except for copies FUSE must keep by law or for evidence, content already shared in marketing material before removal, and reviews and answers that other people rely on, which FUSE may keep without your name. Featuring you in FUSE marketing (featured stores, newsletter, social posts) is optional and needs your separate consent, which you can withdraw at any time.
You promise that:
- you own your content or have every permission needed, including from people shown in photos and videos;
- it is accurate and not misleading, and your opinions are honest and based on your own experience;
- it does not infringe anyone's copyright, trade mark, design, privacy or other rights; and
- it is lawful, and it is not in a category FUSE does not allow (see Schedule A, section 4, and the FUSE Terms of Service).
How FUSE moderates content: FUSE checks store and listing text automatically against the categories it never sells or shows, and refuses a match with a plain message. A person at FUSE reviews every own-equipment and digital listing before it goes on sale, and reviews new and changed stores after they go live. Anyone can report a store or listing with the Report this store link; FUSE acknowledges every report and tells the reporter the outcome. When FUSE acts on content, it decides diligently, objectively and proportionately, and tells you what it decided, why, whether automated tools were involved and how to challenge it (section 17).
Reviews must be genuine. Do not write, buy, swap or ask for fake reviews or endorsements, and do not review your own products or a store you run.
If you believe content on FUSE infringes your rights, report it to [email protected] or with Report this store.
6. Recommending products and saying when you earn
Recommend products honestly and only make claims you can back up. Do not copy manufacturers' claims you have not checked, invent test results or promise things FUSE has not promised.
Whenever you could earn anything (commission, points, credit, free products or a plan benefit) from a recommendation, say so clearly and before the link or offer, in words your audience understands. Good examples: "#ad", "Ad", "I earn a commission from FUSE if you buy through this link". Use the paid partnership or commercial content setting on social media when there is one. A disclosure hidden in a profile, at the end of a long caption or behind "more" is not enough. Your store page shows customers that Igniters may earn from sales; that does not replace your own disclosure elsewhere.
Do not:
- send spam, buy followers or use bots, fake accounts or automated clicks;
- bid on FUSE's name or trade marks in paid search, or use domain names, handles or ads that could be mistaken for FUSE;
- pretend to be FUSE, a FUSE employee or another Igniter; or
- promote your store in a way that breaks the law or the rules of the platform you post on.
The FUSE name and logo are FUSE's trade marks. You may use them only to identify your FUSE store and FUSE products, in the way FUSE's brand guidance allows.
7. Selling your own equipment and digital products
When you list your own used equipment, Schedule A applies as well as these terms. When you list a digital product (such as a licence key, template or course), these terms apply.
For every item you list, you promise that:
- you own it outright, or for a digital product hold the right to resell it, and nobody else has a claim on it (no finance, lease, lien, employer or customer ownership);
- it is genuine, not counterfeit, stolen, recalled or illegal to sell in Malta or in the customer's country;
- it is safe when used as intended, comes with any safety warnings and instructions it needs, and has not been modified in a way that changes how it works or how safe it is;
- your listing describes it accurately and completely, including its condition, faults, missing parts, wear, and whether any licence, warranty or subscription transfers;
- you have removed all personal data, accounts, passwords and activation locks from any device, or reset it to factory settings, before you hand it over; and
- a digital product works as described, licence keys are valid and unused, and you have the right to let FUSE resell them.
Give FUSE the manufacturer's name and contact details and a real photo of the item when you list it, so FUSE can show customers the product information the law requires. FUSE keeps a record of who supplied each item, so that it can name you as its supplier if a customer or an authority asks.
Because FUSE is the seller, FUSE answers the customer for returns and for the legal guarantee. If an item turns out not to match your promises or your listing, FUSE may refund or repair it for the customer and recover the cost from you as set out in Schedule A and section 9. You must help FUSE with any claim, recall or safety notice about an item you supplied, even after you leave the programme.
Private Igniters
FUSE's claim against you for a hidden defect in something you sold is limited to what the law allows between private sellers and buyers (in Malta, the Civil Code rules on latent defects), together with any loss caused by a promise in this section that you knew, or should have known, was untrue.
Business Igniters
You are responsible to FUSE for every lack of conformity in an item you supplied, for as long as FUSE is responsible for it to the customer, and FUSE's legal right of redress against you as the earlier seller in the chain also applies.
8. Earnings, points and FUSE credit
What you can earn, and the current rates, are shown in your hub, on your plan and in each quote. FUSE may change rates for the future with notice under section 23. A change never reduces what you have already earned.
- Helpful Points (HP) recognise your contributions and decide your status. They have no money value and cannot be exchanged for money.
- FUSE credit and shopping points can be spent only on FUSE. They are not money, earn no interest, cannot be withdrawn, sold or transferred, and follow the expiry and use rules shown where you earn them.
- Cash commissions are paid only where FUSE says so for a product, campaign or sale.
An earning becomes available only after the customer has paid, the order has been delivered or collected, the return period has ended without a return and any check FUSE describes has been completed. Until then it is pending. If a sale is refunded, returned, charged back or cancelled, or turns out to be fraudulent, the related earnings, points and credit are reversed, including any that were already available.
FUSE calculates earnings from its order and payment records and shows you how each amount was worked out. If you think an amount is wrong, tell FUSE within 6 months of the date it was shown to you, and FUSE will check it and correct any mistake, in either direction.
FUSE may correct points or credit added by mistake and remove points, credit or earnings obtained in breach of section 12.
9. When you are paid, holdbacks and what you owe
FUSE pays what it owes you in euro, after the earning has become available (section 8) and you have passed the identity and tax checks in sections 10 and 13. The minimum payout and payout schedule are shown in your hub.
Holdback and reserve. To cover refunds, chargebacks (which a customer's bank can raise for about 120 days, sometimes longer) and guarantee claims, FUSE may:
- keep each earning pending until its return period has ended;
- for own-equipment sales, keep back a reserve of [FUSE to confirm: up to 10%] of each purchase amount, released when FUSE's possible claims against you end: [FUSE to confirm: 6 months after delivery for private Igniters and 12 months after delivery for business Igniters];
- hold payouts while a chargeback, dispute, report or investigation about your sales is open, or while FUSE has paused your store with a payout hold under section 17; and
- keep back an amount FUSE reasonably expects to owe customers when you leave, until the related return and guarantee periods end.
FUSE tells you in your hub what is held, why and until when, and releases it as soon as the reason ends.
What you owe FUSE. You owe FUSE: refunds and chargebacks for items you supplied that did not match your promises or listing; the reasonable costs of returning, repairing or replacing them; Stripe dispute fees caused by your breach; amounts paid to you by mistake; and earnings reversed under section 8 after they were paid. FUSE may deduct these from any amount it owes you, on any sale, at any time, including after you leave. FUSE tells you each deduction and why. If what FUSE owes you is not enough, you must pay the difference within 30 days of FUSE's written request.
Private Igniters
You can likewise deduct an amount FUSE owes you from an amount you owe FUSE.
Business Igniters
Stripe may reverse a transfer to your Stripe account to recover an amount you owe, and you authorise FUSE to ask Stripe to do so.
10. Payments through Stripe
FUSE pays Igniters through Stripe. When FUSE asks you to set up payouts, you create a Stripe connected account and complete Stripe's identity verification. Until it is complete, and while Stripe or the law requires, payouts are held.
Payment processing services for Igniters on FUSE are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these terms or continuing to operate as an Igniter on FUSE, you agree to be bound by the Stripe Services Agreement, as the same might be modified by Stripe from time to time. As a condition of FUSE enabling payment processing services through Stripe, you agree to provide FUSE accurate and complete information about you and your business, and you authorize FUSE to share it and transaction information related to your use of the payment processing services provided by Stripe.
If FUSE sets up your Stripe account only to receive payouts: FUSE uses Stripe to make payouts to Igniters. The Stripe Recipient Agreement applies to your receipt of such payouts. To receive payouts from FUSE, you must provide FUSE accurate and complete information about you and your business, and you authorize FUSE to share it and transaction information related to your payout with Stripe.
Stripe processes your personal data as explained in the Stripe Privacy Policy. Stripe's banking partners are listed in the Stripe acquirer disclosure. Your Stripe account is yours: close it with Stripe. FUSE does not hold money for you beyond what these terms say.
11. Paid plans
Paid plans are optional. The price, what each plan includes and how often it is charged are shown before you buy. Plans renew automatically each month or year until you cancel; you can cancel at any time in Billing, and the plan then ends at the end of the period you have paid for. FUSE may change a plan's price or contents for the future with at least 30 days' notice, and you can cancel before the change applies.
Private Igniters
You can withdraw from a new paid plan within 14 days without giving a reason. If you asked for the plan to start straight away, FUSE refunds the price less a fair amount for the days you used.
Business Igniters
Plan fees already paid are not refunded except where these terms or the law say so.
Some plan benefits change how FUSE treats you, for example faster store review on Pro and above (section 16).
12. Fair play and fraud
Do not try to earn anything you have not genuinely earned. In particular, do not:
- buy through your own store, link or referral code, or ask family, friends or people you pay to do so, to earn commission, points or status;
- refer yourself, open more than one account, or use another person's details;
- pay or reward people to sign up, or recruit Igniters for money;
- place orders you intend to return, cancel or charge back, or encourage customers to do so;
- manipulate reviews, votes, clicks, visits or rankings;
- list items you do not have, or take payment or arrange a sale outside FUSE for something listed on FUSE;
- use FUSE to launder money, finance anything illegal or move money for someone else; or
- get around a limit, a hold, a review or a suspension.
FUSE uses automated checks and people to find fraud and abuse. If FUSE reasonably suspects a breach of this section, it may hold the related earnings while it investigates, reverse what was obtained by the breach, and restrict or end your membership under section 17. FUSE tells you what it found and you can explain your side.
13. Tax
You alone are responsible for your own taxes and registrations: income tax, VAT, social security contributions and any registration with Jobsplus or another authority your activity needs. FUSE does not give tax advice; FUSE's notes about Maltese VAT and DAC7 in your hub are general information.
FUSE does not deduct tax from what it pays you unless the law requires it. Amounts FUSE shows include VAT only where your quote or plan says so.
Reporting by FUSE (DAC7). Platforms must collect and report information about sellers to the Maltese tax authorities, which share it with other EU tax authorities. When the law requires it, you must give FUSE your name, address, date of birth, tax identification number and place of issue (or place of birth), VAT number and, for a company, its registration number. FUSE checks these details, reports your sales and the amounts paid to you, and sends you a copy of what it reported by 31 January of the following year. If you do not give the details after two reminders, the law requires FUSE, after at least 60 days, to close your account, stop you registering again, and hold your payments until you provide them.
Business Igniters
If you are VAT registered you must give FUSE a valid VAT invoice for what you sell to FUSE, or agree to FUSE's self-billing arrangement where FUSE offers one. You must pay FUSE back for any tax, interest or penalty FUSE has to pay because the details you gave were wrong or incomplete.
Private Igniters
If FUSE has to pay tax, interest or a penalty because you knowingly or carelessly gave wrong tax details, you must pay FUSE back.
14. Personal data
FUSE is the controller of the personal data it collects about you as an Igniter (for example your account, store, tax, payout and acceptance details) and uses it as explained in the Privacy Policy: to run the programme and pay you, to prevent fraud, and to meet legal duties such as tax reporting and record keeping. FUSE shares what is needed with Stripe, with the tax authorities and with service providers who work for FUSE.
Customer data. FUSE is the controller of customers' personal data. FUSE shows you only what you need for an order or a conversation, for example a delivery address for an order you ship. You may use it only to fulfil that order or answer that customer, and only for as long as that takes. You must not copy, export, sell or share it, add it to a mailing list, or contact customers for any other purpose unless they have separately agreed to hear from you. Keep it secure, delete it when you no longer need it, and tell FUSE within 24 hours if it is lost, stolen or seen by someone who should not see it. If you use customer data for your own purposes in breach of this section, you are responsible for that use under data protection law.
Data access. While you are an Igniter you can see your store's orders, earnings, customers' questions and reviews, and the statistics in your hub. FUSE has access to all data on FUSE, including data about your store, and uses it to run, secure and improve FUSE; FUSE does not sell it. FUSE does not give you data about other Igniters' stores. After you leave, FUSE keeps the records the law requires (orders, payments and tax records for up to 10 years) and your acceptance records as evidence, and you can ask for a copy of your own data under data protection law.
15. NOVA and other automated tools
NOVA is FUSE's AI assistant. It can answer customers' questions on your store and help you write listings. NOVA's answers are produced automatically and are labelled as AI. They may be incomplete or wrong, so check anything NOVA writes for you before you publish it: what you publish is your content (section 5). NOVA does not give legal, tax, financial or safety advice.
Customers are told when an answer comes from NOVA rather than from you. FUSE may review conversations with NOVA to keep it safe and accurate.
FUSE also uses automated tools to screen content, detect fraud and calculate earnings. A person at FUSE takes every decision to pause, restrict or end your membership.
16. How stores are ranked and treated
Where FUSE lists or features Igniter stores (for example Shop Igniter stores on the FUSE homepage), it shows only published stores with a live listing whose owner agreed to be featured. The order is decided by these main parameters, in this order of importance: a store FUSE has chosen to feature (picked by people at FUSE for quality, range and customer experience); the number of visits the store received in the last 30 days, because it shows what customers find useful; and how recently the store was active. Within a store, FUSE catalogue products and listings with real photos are shown first. Nobody can pay FUSE to rank higher, and a paid plan does not change ranking.
Different treatment. FUSE sells its own catalogue on fuse.systems and is the seller of every Igniter sale, so FUSE has access to all sales and customer data. Paid plans give a lower commission on your own products while the plan is active, higher listing limits, faster store review (Pro and above), Fulfilled by FUSE eligibility (Max and above) and a dedicated contact (Ultra and above). Earned status does not change the commission rate. FUSE does not otherwise treat Igniters differently.
You may sell the same products elsewhere at different prices and on different terms.
17. Restricting, pausing and ending membership
FUSE may remove a listing, restrict a feature, hide your store, pause your store or payouts, or end your membership only for one of these reasons:
- an illegal product or illegal content, or one FUSE does not allow;
- counterfeit or infringing goods, or content that infringes someone's rights;
- suspected fraud, a scam or abuse under section 12;
- identity, business or tax details that are missing, false or cannot be verified, including when Stripe cannot verify you;
- repeated or serious customer complaints, or a high rate of returns, disputes or chargebacks on items you supplied;
- another breach of these terms or Schedule A;
- an order from a court or authority, or a legal duty, including sanctions, tax and payment rules; or
- a risk to the safety or security of customers, Igniters or FUSE that FUSE must act on quickly.
FUSE's response is proportionate: for example it removes one listing rather than your store when that is enough. When FUSE takes one of these steps it tells you by email, at the latest when the step takes effect, what it decided and for how long, the facts it relied on (including whether it followed a report), whether automated tools were involved, the section of these terms or the law it relied on, and how to challenge it. If the decision is reversed, FUSE restores your store and data without delay.
Business Igniters
Ending your membership. Except in the cases in the next paragraph, FUSE gives you at least 30 days' notice, with its reasons, before ending your membership, and you can respond within that time.
Private Igniters
Ending your membership. Except in the cases in the next paragraph, FUSE gives you reasonable notice, at least 30 days, with its reasons, before ending your membership.
FUSE may end your membership with immediate effect, giving its reasons straight away, if the law requires it, if FUSE has a serious ground under Maltese law, or if you have repeatedly breached these terms.
Leaving. You can stop selling, pause or close your store, and end your membership, at any time, free of charge, in your hub or by emailing [email protected]. Your store stops selling at once. It closes, and your membership ends, once your open orders, return periods, refunds, disputes and payouts have cleared (for business Igniters who sold their own equipment, also the legal guarantee period). Your hub shows what is left and when it clears.
After you leave or FUSE ends your membership: FUSE pays what it owes you under sections 8 and 9, less what you owe; customers can still reach FUSE about their orders, and FUSE may email them to say your store has closed; your store address is held for a while so nobody else can pretend to be you; and sections 5 (licence for content already shared), 8 and 9 (money owed), 13 (tax), 14 (personal data), 18 to 20 and 25 to 26, and your promises about items you supplied, continue to apply.
18. Complaints and disputes
If you are unhappy with anything FUSE did or decided, including a decision under section 17 or about content, tell FUSE by email to [email protected], or by replying to the email about the decision, within 6 months. It is free. Someone who did not take the original decision looks at it, and FUSE answers you in writing, in plain language, as quickly as the matter allows and normally within 30 days.
If that does not settle it, both sides may agree to try mediation; FUSE pays a reasonable share of the mediator's costs. Mediation never stops either side going to court.
Private Igniters
You can also contact the Malta Competition and Consumer Affairs Authority, use an approved consumer dispute body, or bring a claim before the Consumer Claims Tribunal or the courts.
19. Responsibility for losses
Nothing in these terms limits or excludes anyone's liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, under product liability law, or for anything else the law does not allow to be limited or excluded. Nothing in these terms takes away rights the law gives you as a consumer.
FUSE's responsibility to you. FUSE is responsible for loss you suffer that is a foreseeable result of FUSE breaking these terms or failing to use reasonable care and skill. FUSE is not responsible for:
- loss that was not foreseeable when you accepted these terms;
- loss caused by something outside FUSE's reasonable control (section 22);
- loss caused by you, a customer, Stripe, a carrier or another third party that FUSE is not responsible for; or
- the availability of the website at every moment: FUSE takes reasonable care to keep it running, but maintenance and faults happen.
Business Igniters
FUSE is not responsible to you for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss. FUSE's total responsibility to you for all claims in any 12 months is limited to the greater of [FUSE to confirm: €500] and the total FUSE paid or credited to you in the 12 months before the event that caused the claim. This limit does not apply to amounts FUSE owes you for sales or to anything in the first paragraph.
Private Igniters
FUSE does not limit its responsibility to you by an amount. As a private Igniter you take part outside any business, so FUSE is not responsible for business losses, but it is responsible for amounts it owes you for sales.
Your responsibility to FUSE. You are responsible for loss FUSE suffers that is a foreseeable result of you breaking these terms or the law, including amounts FUSE has to pay customers because an item you supplied did not match your promises or your listing.
20. Claims by others
Business Igniters
You will pay FUSE back for the losses, damages, fines, tax, reasonable legal costs and amounts paid in a settlement that FUSE suffers because of a claim or action by a customer, a rights holder, an authority or anyone else that arises from your content, an item you supplied, your breach of these terms or the law, your tax affairs or your use of customer data. FUSE will tell you promptly about the claim, let you comment on how it is handled, and not settle it without first consulting you.
Private Igniters
Section 19 sets out what you are responsible for. You do not give FUSE a wider indemnity, but you must help FUSE answer any claim about an item you supplied or content you published.
21. Insurance
Business Igniters
Business Igniters who sell their own equipment should hold product and public liability insurance suitable for what they sell. FUSE may ask for proof of insurance before approving higher-value or higher-risk listings.
22. Events outside anyone's control
Neither you nor FUSE is responsible for a delay or failure caused by an event outside its reasonable control that it could not reasonably have avoided or overcome, such as a natural disaster, war, epidemic, strike at a third party, power or internet failure, cyber attack, or the failure of Stripe, a carrier or another provider. The affected side must tell the other promptly and do what it reasonably can to limit the effect. If the event lasts more than 60 days, either side may end the agreement by notice. This section does not excuse paying money that is due, and it does not affect a customer's rights.
23. Changes to these terms
FUSE may change these terms only for a valid reason: a change in the law or in a decision of a court or authority; a change to how the programme, payments or delivery work; adding or changing a feature, plan or earning; preventing fraud, abuse or security risks; a change required by Stripe or another provider; or to make the terms clearer.
FUSE tells you about a change by email and in your hub at least 15 days before it applies, with a summary of what changes. FUSE gives longer notice when you need time to adapt, for example to change your listings or how you work. Every version, and the date it applies from, is published.
If you do not agree with a change you can end your membership before it applies, free of charge (section 17). If you do nothing, the new version applies from its date; to keep publishing your store or to receive payouts after that date, FUSE asks you to confirm that you accept it. If you decide to leave instead, FUSE pays what it owes you under the version that applied when you earned it.
You can accept a change straight away in your hub; it then applies to you from your acceptance. A business Igniter who adds new listings during the notice period is treated as accepting the change early, unless the notice period is longer than 15 days because the change needs significant technical changes to your listings.
FUSE may change these terms with less notice only when a law or an authority requires it to change them sooner, or to deal with an unforeseen and imminent danger of fraud, malware, spam, a data breach or another security risk. FUSE never changes these terms with retroactive effect, except where the law requires it or the change benefits you.
24. Transferring the agreement
FUSE may transfer this agreement to a company in its group or to a business that takes over the Igniter programme, and will tell you. If you are a private Igniter, FUSE will only do so where your rights under this agreement are not reduced, and you can end your membership if you do not agree. You may not transfer your membership, store or earnings to anyone else without FUSE's written agreement.
25. General
- These documents are the whole agreement between you and FUSE about the Igniter programme. Nothing in this point limits liability for fraud or for anything FUSE told you before you joined.
- If a court decides that part of these terms is invalid or unfair, the rest stays in force, and the invalid part applies to the extent the law allows.
- If FUSE does not enforce a right straight away, it can still enforce it later.
- FUSE contacts you by email and in your hub; email is FUSE's main way of giving you notices. Keep your email address up to date. Send notices to FUSE at [email protected].
- Nobody other than you and FUSE has rights under this agreement.
