1. Introduction
These Terms of Service ("Terms") govern your access to and use of the FUSE platform ("Service"), operated by YOT LTD (Company Registration: C93877, VAT: MT26786902), a company registered in Malta with its registered address at 31, Triq l-Imdina, H'Attard ATD9039, Malta.
2. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.
3. Account Registration
You must provide accurate and complete registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Consumer and B2B accounts are subject to their respective additional terms.
4. Orders & Pricing
All prices are displayed in EUR and exclude VAT unless stated otherwise. We reserve the right to correct pricing errors before order fulfilment. Orders are confirmed upon successful payment processing or, for qualified B2B accounts, upon credit approval. Product availability is subject to stock levels at the time of order processing.
5. Payment Terms
Consumer accounts: payment is required at the time of purchase via accepted payment methods (credit/debit cards, bank transfer). B2B accounts: approved business customers may be eligible for NET payment terms (NET-30, NET-60) subject to credit approval. Late payments may incur interest as permitted by applicable law.
6. Shipping & Delivery
Delivery times are estimates and may vary depending on product availability, destination, and courier schedules. Risk of loss passes to you upon delivery. We will provide tracking information where available.
7. Returns & Refunds
Returns are subject to our Returns Policy. Consumers benefit from a 14-day cooling-off period under EU Distance Selling Regulations. Please refer to the Returns Policy for full details on eligibility, process, and refund timelines.
8. Intellectual Property
The FUSE platform, brand, and all associated content are the property of YOT LTD. User-generated content (reviews, guides) grants YOT LTD a non-exclusive, royalty-free licence to display and distribute such content on the platform.
9. Limitation of Liability
To the maximum extent permitted by applicable law, YOT LTD shall not be liable for indirect, incidental, special, or consequential damages. Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the amount paid by you for the relevant product or service.
10. Termination
We may suspend or terminate accounts that violate these Terms or engage in fraudulent activity. You may close your account at any time through your account settings or by contacting us at sales [at] yotltd [dot] com.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malta. Any disputes shall be subject to the exclusive jurisdiction of the Maltese courts, without prejudice to mandatory consumer protection laws of your country of residence.
